چکیده

موسیقی پدیده‌ای است که در تاریخ زندگی بشر نقش انکارناپذیری دارد. برای پی بردن به این امر، کافی است پیشینة حضور آن را در جوامع گوناگون بشری مورد مطالعه قرار دهیم.
مطالعة موسیقی، از نظرگاههای تاریخی، علمی، هنری، روان‌شناسی و فقهی امکان‌پذیر است و هر یک از جهات نامبرده نیازمند تحقیقات گسترده و خاصّی است، ولی آنچه در این گفتار در پی آنیم، تحلیل جوانب فقهی مسئله است. این بحث را فقهای شیعه و مذاهب اهل سنّت مورد توجّه قرار داده و لااقل در دو موضع، یعنی کتب متاجر بخش مکاسب محرّمه و شهادات، از آن بحث کرده‌اند.

Music is a phenomenon that has an undeniable role in the history of human life. To understand this, it is sufficient to study the background of its presence in the different society of human being. Studding the music from the historical, scientific, artistic, psychological and juridical point of view is possible and each of them requires detailed and particular investigations, but what we deal with in this paper is the analysis of its juridical aspects. This subject is discussed among both Shiite jurisprudents and Sunnite sects and it is discussed at least in two places in the book of trades, prohibited trades and witnesses.
