The possibility or impossibility of marrying an adopted child is one of the challenging issues in the legal system of Iran and many other countries. Unlike other Islamic countries, Tunisia, under the influence of French law as well as Polish family law, has accepted kinship through adoption and its effects, including the prohibition of marriage with a guardian. The author uses a descriptive-analytical method based on the rules of the marriage license with the adopted child Criticizing the views of Islamic scholars and the laws of Tunisia, France and Poland, she believes:Islamic jurisprudence has thought more progressively on this issue than many legal systems And puts the issue in the circle of the will and authority of the adopted child and the adopted child as a whole And respect for their free will, which is a matter of human rights However, the mentioned legal systems have obviously legislated against this. The present analysis, as a theory, frees the jurists from the clutches of many problems And it can be designed as a chair of theorizing.
