Without a doubt, as stipulated in Article 719 of the Civil Law, the release of the guarantor results in the loss of the guarantor's right to recourse against the principal. However, the provision for a debt donation the creditor to the guarantor is not included in the law. The purpose of the article is to state the jurisprudential and legal reasons for the lack of a right of recourse the guarantor to the principal before payment of the debt and after the debt donation to the guarantor. The findings of the research, which is based on a descriptive-analytical method, show that according to the narrations in jurisprudence and the famous opinion of jurists, the origin of the guarantor's recourse to the principal is the damage caused by the guarantor's payment of the debt. In addition, before the debt is paid, the guarantor's damages are not certain, and therefore are not subject to the rule of no-harm as the basis for the guarantor's right of recourse. From a legal perspective, the arguments of those in favor of the right of recourse are flawed. On the one hand, the Article 712 cannot be relied upon, because the guarantor's recourse after debt inheritance was not without consideration, but after debt donation, it is absence of consideration and without incurring any loss.
