Every phenomenon in society is the result of the evolution of previous phenomena.The legal system does not manage the country alone and Political force cannot handle social realities. The foundations of law are formed in the basic roots of society. The law cannot be interpreted and analyzed in isolation from society. What happened in Iran after the Islamic Revolution in the field of legislation on land ownership, it is a kind of haste to offer a solution and meet the expectations of the revolutionary people based on jurisprudential and revolutionary views. The new legislation was the last result of the wise, based on experience and under the protection of jurisprudence, for the benefit of some members of society. Challenges in front of the foundations of land ownership change have been the subject of much debate and to analyze it, the records of the subject must be examined and compared with the jurisprudential and legal system. In this regard, while identifying these challenges, the foundations of land ownership evolutions are analyzed; the goal is not simply to discover the rules of jurisprudence as a basis. This article analyzes the hypothesis of the absolute impact of revolutionary views on the expropriation of private property and the termination of public property; Finally, the result that is obtained expresses the influence of revolutionary views with the support of jurisprudence and law, along with social, economic and political conditions on land ownership evolution after the Islamic Revolution.
