Investigating the Legitimacy of Investing with Khums and Zakat Property Based on the Principles of Imam Khomeini (RA)

Abstract

Each of Khums and Zakat are the secondary Shariah obligations that God Almighty has made obligatory on Muslims. The philosophy of these two divine obligations is the financial provision and the basic necessities of life for certain classes of people in the society. The management of these two financial obligations was the responsibility of the Prophet (PBUH) and the infallible imams (AS) at the age of them, but there is a strong disagreement among the jurists, both Sunni and Shia about who is responsible in the age of occultation. These disagreements turn into two basic ideas: 1) ownership and management of these two financial obligations is the responsibility of the just Islamic government (Walayat al-Faqih), 2) Khums and Zakat payers can spend according to Shariah standards in the specified consumption cases. This article, according to the first basic idea, investigated the legitimacy of investment with khums and zakat property based on the principles of Imam Khomeini, with a descriptive-analytical and library method, and came to the conclusion that the legitimacy of this investment is not only possible, but in some circumstances it may seem necessary. The proof of this point of view has many fruits in the field of financing Islamic governance and meeting the needs of the place, especially in Islamic seminaries; this also provides the necessity of this discussion.
