Abstract

Theoretical bases of mine’s ownership have not determined in Mines law because of multiplicity and conflict of laws in this context. Iran’s civil law has recognized private ownership in mines object under the influence of Shia’s jurisprudence, on the other hand public ownership of mines passed in 1370 for maintaining the authority of government. In addition calculation and receipt of royalties, is unstable and ambiguous in different mine territories in Iran.

Australian and American legal systems are pioneer ones with cohesive bases in mine domain. So the ownership of mines and the rules of mines law are studied in this article in descriptive- analytical method, especially about ownership of persons over minerals after issuance of different licenses and viewpoints about ownership of mines in Shia’s jurisprudence. Findings show that for more attraction of internal and foreign investment, private law approach should be dominant over public law approach in ownership of mines in order to proper exploitation from mineral resources and amendment of mines legislations.
