Abstract

In the jurisprudence of transactions, the defect option, as one of the legal bases for the dissolution of the contract, provides the possibility of terminating the sale contract in the event of the discovery of a hidden defect. In such cases, the payment of the arsh is considered as an alternative mechanism for the continuation of the contract. However, the legal nature of the arsh has always been at the center of jurisprudential disagreements.

This research, using a descriptive-analytical method and examining jurisprudential evidence, examines two major views in this field: the traditional view that considers the arsh to be part of the price and the dominant view that, citing the prophetic prohibition of combining the awd and muawadd, considers it to be an independent compensation.

The research findings show that the theory of the arsh being a compensation has a stronger argumentative support, citing reasons such as: avoiding the discrimination of the transaction, conforming to the rational structure, analyzing the nature of the seller's liability, and preventing legal contradictions. This view, which is also supported by most later jurists, has been established as the most correct theory in the Imamiyyah jurisprudence system.
