Abstract

inconsistency between the provisions ofthe oral marriage contract and the provisions contained in the official marriage certificate.Sometimes, although the inner and outer will of the couple is committed to a specific marriage and there is genuine consent between them, the provisions contained in the marriage certificate are not consistent with that will and sometimes even conflict with it. in some cases, couples conclude the marriage contract absolutely, without including any conditions or by verbally mentioning specific conditions; however, when preparing the official document, they sign the printed conditions included in the marriage certificate or other additional conditions. Its necessary to distinguish this situation from the situation where couples, after concluding a formal marriage, make new agreements in the form of secondary contracts, because the legal and jurisprudential effects of these two situations are different. The main question is whether the conditions mentioned in the formal document are subordinate to the marriage contract in terms of necessity, permissibility, and legal effects, or are they considered an independent contract? In cases where the couple concludes the marriage contract absolutely and unconditionally and signs printed conditions and even additional conditions when preparing the official document, these conditions are considered independent contracts from alegal perspective that were concluded after the original contract was completed, and their effects will also be subject to the general rules of contracts.this research, using a descriptive-analytical method, the legal and jurisprudential foundations of the issue are examined, as well as the legal status of the aforementioned conditions and judicial practice inthis regard.
