Abstract

In Iranian jurisprudence and law, among the effects that are imposed on marriage is inheritance between spouses, and according to Iranian civil law and Jafari jurisprudence, one of the types of marriage is also temporary marriage, which is considered in Iranian jurisprudence and law, which is defined by the legal jurists. Shari'a has been legislated by the law. Now, one of the important issues regarding temporary marriage is that if the parties make an inheritance condition during this contract, what will be the result of this condition? Will the parties inherit from each other with this condition? If it is the cause of Islamic inheritance, will this condition not be the inheritance of a person who is not an heir? In the current research, according to the library method and based on analytical-descriptive method, it has been concluded that the condition of inheritance is a valid condition and valid and enforceable if stipulated by the couple.
