Journal Article 2025 12 08 Some jurists have not considered the conditioned contract valid because it is dependent on a possible external matter and lacks certainty, and have considered it to be a condition for the validity of the contract to be fulfillment. However, Imam Khomeini (RA) and Ayatollah Khoei (RA) have challenged such a condition, but they disagree with each other on the fundamental principles and arguments put forward. The question is on what basis and in what format the theoretical principles of each of these scholars were put forward. This article has been compiled in a descriptive-analytical manner and with reference to authoritative jurisprudential books and related articles in Persian and Arabic. Although each of them has presented the issue in the form of a conditional obligation to challenge the condition of fulfillment, they have fundamentally disagreed on the reference of the condition to the body and the substance, and they also disagree on the possibility of separating the cause from the cause and the generation from the origin. So that the Imam considers suspension in the composition possible and suspension in the generation invalid, but Ayatollah Akhoui considers suspension in the origin correct.. برخی از فقها عقد معلق را چون به یک امر خارجی احتمالی وابسته و فاقد جزمیت بوده صحیح ندانسته و یکی از شرایط صحت قرارداد را تنجیز دانسته اند. با این حال امام خمینی (ره) و ‌محقق خویی چنین شرطی را به چالش کشیده اما در مبانی و استدلال‌های بنیادی مطرح شده بایکدیگر اختلاف نظر دارند. سوال این است که مبانی نظری هر کدام از این علما بر چه اساسی و در چه قالبی مطرح شده است. این‌ نوشتار‌ به‌ صورت‌ توصیفی‌ –‌ تحلیلی‌ و‌ با‌ مراجعه‌ به‌ کتب‌ معتبر‌ فقهی‌ و‌ مقالات‌ مرتبط‌ به‌ زبان‌ فارسی‌ و‌ عربی‌ تدوین‌ گردیده‌ است.‌ هر چند هر کدام از ایشان برای به چالش کشیدن شرط تنجیز موضوع را در قالب واجب مشروط مطرح اما از حیث اصولی در مورد ارجاع قید و شرط به هیئت و ماده اختلاف نظر داشته و همچنین در امکان تفکیک سبب از مسبب و انشاء از ‌منشاء نیز اختلاف نظر دارند. به طوری که امام تعلیق در انشاء را امکان‌پذیر و تعلیق در ‌منشاء را باطل اما محقق خویی تعلیق در ‌منشاء را صحیح می‌داند. https://cjd.razavi.ac.ir/article_2331_b368da7e0213bd94390d831fbac2ce06.pdf
