The point of difference is how to determine its status, conditions and validity. At the same time, the greater validity of the precepts of the meaningful transactions of the world indicates the importance of rationality in jurisprudence. (At the same time, the more general verdicts of the verdicts confirm the importance of rationality in jurisprudence.) The exquisite views of some jurists in the study of the material and spiritual components of the Sirae are the basis for the significant works in contractual responsibility. Based on the findings of this essay written in a descriptive-analytical manner, it can be said that, in addition to relying on the evidence of coercive assertion to substantiate the principle of contractual liability, this type of disclaimer is indisputable, and does not imply explicit or implied (This type of responsibility is certain and it is not correct to subject it to explicit or implied). therefore, article 221 of the Civil Code is incorrect. In addition, relying on the organic and instrumental role of the rational process in understanding the rules of loss, ala al-yad and prohibition of detriment, the radius of responsibility encompasses non-profit damages. The of liability covers the non-profit losses incurred. On this basis, the amended Articles 221 of the Civil Code and Note 2 of Article 515 of the Code of Civil Procedure have been proposed. The overall approach of this article is to endorse the theory of unity of accountability and is in line with jurisprudence. At the same time, however, it differs from the well-known view of jurists, in that it argues that coercive damages include non-profit damages. (At the same time, it differs from the famous view of jurists in that it is argued that forcible indemnification involves non-profit damages.) Definite non-profit damages whether due to usurpation of property, human imprisonment, or breach of contract.  }, keywords = {Rationale,Custom,Contractual civil liability,Non-profit damages}, title_fa = {کاوشی در نقش سیرۀ عقلا در تعیین دامنۀ مسئولیت قراردادی با تکیه بر نظر امام خمینی و شهید صدر}, abstract_fa = {نقش‌آفرینی «سیرۀ عقلا» در استنباط احکام شرعی، کم و بیش مورد توجه فقها بوده است. چگونگی احراز سیره، شرایط و میزان اعتبار آن، محل اختلاف دیدگاه‌هاست. در عین حال، امضایی بودن بیشتر احکام معاملات بالمعنی الاعم، از اهمیت بناء عقلا در فقه حکایت دارد. نظرات بدیع برخی از فقیهان در تحصیل مؤلفه‌های مادی و معنوی سیره، پایه‌گذار مبنایی است که آثار قابل توجهی در مسئولیت قراردادی ایفا می‌کند. بر اساس یافته‌های این نوشتار که به شیوه توصیفی تحلیلی نگاشته شده، می‌توان گفت که افزون بر امکان استناد به ادله ضمان قهری در اثبات اصل مسئولیت قراردادی، به استناد سیرۀ قطعی عقلا، این قسم مسئولیت، امروزه مسلّم است و منوط کردن آن به اشتراط صریح یا ضمنی صحیح نیست. بنابراین شیوۀ تدوین ماده 221 قانون مدنی نامناسب است. علاوه بر آن، با تکیه بر نقش آلی و ابزاری سیرۀ عقلا در فهم قواعد اتلاف، علی‌الید و لاضرر، شعاع مسئولیت، خسارت‌های عدم‌النفع مسلّم‌الحصول را در بر می‌گیرد. بر این بنیان، مواد اصلاحی جایگزین مواد 221 قانون مدنی و تبصره 2 ماده 515 قانون آیین دادرسی مدنی، پیشنهاد شده است.رویکرد کلی مقاله حاضر در تأیید نظریه وحدت مبانی مسئولیت است و از این جهت با فقه همسوست، در عین حال از این نظر که ادله ضمان قهری را شامل خسارت‌های عدم‌النفع قطعی می‌داند، با نظر مشهور فقها تمایز دارد؛ خسارت عدم‌النفع قطعی چه ناشی از غصب مال باشد یا حبس انسان حرّ و یا نقض قرارداد.}, keywords_fa = {سیره عقلا,عرف,مسئولیت مدنی قراردادی,خسارت عدم‌النفع}, url = {https://cjd.razavi.ac.ir/article_482.html}, eprint = {https://cjd.razavi.ac.ir/article_482_6c8bbd64a71ba42e824948a82ce57659.pdf} }
