Concerning the condition of its effect in Article 217 of Civil Law it is stated that in order to influence the illegitimate direction (that is the nullity of the contract), which must be specified. Therefore, in the case of knowledge of one of the parties to the contrary which is illegal to the side, the contract is correct. This is while there is a discrepancy between the jurisprudents of Imamiyah, in a way which some who consider it permissible and some void. In the present research, after explaining the meaning of illegitimate direction, and quoting legal interpretation on the issue, jurisprudential principles on the issue, such as specific narrations, and prohibited contributions to sin, with considering the intention of lawgiver to eliminate the corruption of matter has been investigated and finally, the nullity of the contract is accepted if it is one-sided for illegal direction and knowledge of the other party and principles such as the principle of validity cannot prevent the void arbiter progress and it was concluded that the criterion for influencing the illegitimate direction, is identification or positivity ( and not specification of that) Therefore, it is suggested to the respectable legislator in future amendments (reforms) of the civil law.  }, keywords = {Illegal purpose,Trading purpose,Knowledge,Specification,Prohibition,Nullity}, title_fa = {پژوهشی در ملاک تأثیر جهت نامشروع: تصریح یا احراز؟! (واکاوی مبانی فقهی ماده 217 قانون مدنی)}, abstract_fa = {مطابق ماده 190 قانون مدنی، مشروعیت جهت، یکی از شرایط اساسی صحت معاملات به حساب می‌آید. در خصوص شرط تأثیر آن در ماده 217 ق.م. آمده است که برای تأثیر جهت نامشروع (یعنی بطلان قرارداد)، باید تصریح نسبت به آن صورت پذیرد. بنابراین در صورت علم یکی از طرفین به جهت نامشروع طرف مقابل، قرارداد صحیح می‌باشد. این در حالی است که این مسئله در بین فقهای امامیه اختلافی است؛ به نحوی که برخی آن را جایز و برخی باطل می‌دانند. در پژوهش حاضر بعد از تبیین معنای جهت نامشروع و نقل تفاسیر حقوقی ناظر بر بحث، مبانی فقهی ناظر بر مسئله از قبیل روایات خاصه و حرمت اعانه بر اثم، با در نظر گرفتن غرض شارع مبنی بر قلع مادۀ فساد، مورد واکاوی واقع شده و در نهایت، بطلان قرارداد در صورت یک طرفی بودن جهت نامشروع و علم طرف مقابل به آن مورد پذیرش واقع شده است و اصولی چون اصل صحت نمی‌تواند مانع از جریان حکم بطلان شود و این نتیجه حاصل شد که ملاک برای تأثیر جهت نامشروع، احراز یا اثبات آن (و نه تصریح به آن) می‌باشد. لذا توجه به این امر در اصلاحات آتی قانون مدنی به قانون‌گذار محترم پیشنهاد می‌شود.}, keywords_fa = {جهت نامشروع,جهت معامله,علم,تصریح,حرمت,بطلان}, url = {https://cjd.razavi.ac.ir/article_480.html}, eprint = {https://cjd.razavi.ac.ir/article_480_ba6096bb1139ecedfd3981d563d165c9.pdf} }
