This obligation sometimes without disclosure of patients’ names in cases like dangerous disease outbreaks is entrusted to the upstream institutions such as the Ministry of Health and Medical Education (MOHME). The obligation to warn which includes disclosure of patients’ names firstly was mentioned in Tarasoff case. Its law has provided the circumstances of this obligation which is counted an exception to the principle of secrecy and confidentiality in medical law. In spite of its importance, the law of Iran does not have an explicit rule. But besides the implicit indications in some regulations based on Islamic jurisprudential maxims such as the mandatory of preserving Muslim’s life, it can be accepted the existence of this obligatory in general for the physician. Moreover this obligation provides the required interests which are emphasized by Islamic law such as preserving life and property. therefore even in the situation of the refusal and doubt in the indication of primary evidences to such obligation, the Islamic governor (ruler) to provide personal and public interests can assign the physician this obligation with the determined provisions and regulations. Of course the obligation of warning being an exception to the principle of secrecy and confidentiality, specifying its circumstances and conditions such as determining illnesses which creates obligation and determining the non-patients who are beneficiaries with applying circumstances like the circumstance of identifiable (identified) third parties Is vital.}, keywords = {Duty to warn or duty to inform,Secrecy and confidentiality,Physician or doctor,Patient,Non-patient}, title_fa = {تعهد اطلاع‌رسانی پزشک معالج به اشخاص غیر بیمار؛ مطالعه تطبیقی در حقوق ایران و ایالات متحده آمریکا}, abstract_fa = {تعهد اطلاع‌رسانی پزشک معالج به اشخاص غیر بیماری که از ناحیه اشخاص بیمار در معرض خطر جدی قرار دارند، نقش مهمی در حفظ و ارتقای سلامت عمومی جامعه دارد. این تعهد گاهی بدون افشای نام بیماران، در مواردی مانند شیوع بیماری‌های اپیدمیک خطرناک، بر عهده نهادهای بالادستی مانند وزارت بهداشت قرار دارد. در مواردی نیز پزشک معالج به محض تشخیص بیماری خطرناک، ضمن افشای نام بیمار، مکلف به اطلاع‌رسانی به اشخاص غیر بیمارِ در معرض خطر است. تعهد اطلاع‌رسانی که متضمن افشای نام بیمار باشد، نخستین بار در حقوق آمریکا با پرونده «تاراسوف» مطرح شد. حقوق این کشور، به تعیین ضوابط این تعهد که استثنایی بر اصل رازداری و حفظ محرمانگی در حقوق پزشکی محسوب می‌شود، پرداخته است. علی‌رغم اهمیت موضوع، حقوق ایران در این خصوص حکم صریحی ندارد. اما علاوه بر دلالت ضمنی برخی مقررات قانونی، بر اساس برخی قواعد فقهی همچون وجوب حفظ جان مسلمان می‌توان فی‌الجمله وجود چنین الزامی را برای پزشک معالج پذیرفت. به علاوه این تعهد، مصالح ملزمۀ مورد تأکید شریعت مانند حفظ نفس و حفظ مال را تأمین می‌نماید. لذا حتی بر فرض عدم پذیرش و تردید در دلالت ادله اولیه بر وجوب چنین تکلیفی، حاکم اسلامی برای تأمین مصالح فردی و اجتماعی، می‌تواند چنین تکلیفی را با ضوابط و شرایط معین بر عهدۀ پزشک معالج بار نماید. البته با توجه به اینکه تعهد اطلاع‌رسانی، استثنایی بر اصل رازداری و حفظ محرمانگی است، تعیین شرایط و ضوابط آن از جمله تعیین بیماری‌های موجد تعهد و تعیین اشخاص غیر بیمار ذی‌نفع، با استفاده از ضوابطی مانند ضابطه «قابلیت شناسایی» ضروری است.}, keywords_fa = {تعهد اطلاع‌رسانی,رازداری و حفظ محرمانگی,پزشک,بیمار,اشخاص غیر بیمار}, url = {https://cjd.razavi.ac.ir/article_1334.html}, eprint = {https://cjd.razavi.ac.ir/article_1334_8d4e4f29b3a983629aa6707eff6e8216.pdf} }
