Does the tribunal itself without the consent of the parties in the claim exercise the religious law as the non-state legal rules? Sometimes parties of the commercial agreement for reasons such as religious interests tend to exercise the religious law as the governing rules over the agreement. Sometimes, the tribunal in spite of the silence of the parties in the claim will enforce a non-state law over the subject matter of the arbitration. Although the reality of the commercial world makes it possible to be chosen and enforced the religious principles by parties and the arbitral tribunal in the international commercial contracts but the practical procedure and the regulations of the arbitration in the different legal systems indicating impossibility of enforcement of the religious law by the arbitrators in the supposition of the silence of parties in claim (parties of claim or dispute). }, keywords = {The international commercial arbitration,Governing law,Religious law,Arbitral tribunal,The arbitration rules}, title_fa = {قلمرو اعمال حقوق مذهبی به عنوان قانون حاکم در مراجع داوری}, abstract_fa = {گسترش قراردادهای تجاری بین‌المللی و انتزاع روزافزون قوانین ملی از ریشه‌های مذهبی از یکسو و قواعد آمرۀ مندرج در نصوص مذهبی در باب معاملات از سوی دیگر، این مسئله را پدید آورده است که آیا اصحاب قرارداد می‌توانند با عدول از قوانین ملیِ مصوب دولت‌ها، به انتخاب حقوق مذهبی به عنوان قانون حاکم بر قرارداد مبادرت نمایند و آیا مرجع داوری رأساً بدون نیاز به توافق اصحاب دعوی، اجازه اعمال حقوق مذهبی را به عنوان قواعد حقوقی غیر دولتی دارد؟ گاه طرفین قرارداد تجاری به دلایلی از قبیل علایق مذهبی، تمایل به اعمال حقوق مذهبی به عنوان قانون حاکم بر قرارداد دارند و گاه مرجع داوری با وجود سکوت اصحاب دعوی، رأساً در پی اعمال یک حقوق غیر دولتی بر قرارداد موضوع داوری است. هرچند واقعیت دنیای تجاری، امکان انتخاب و اعمال قواعد مذهبی را از سوی طرفین و مرجع داوری در قراردادهای تجاری بین‌المللی مجاز می‌داند، لیکن رویه عملی و مقررات داوری در سیستم‌های حقوقی مختلف، حاکی از عدم امکان اعمال حقوق مذهبی از سوی داوران در فرض سکوت اصحاب دعوی است.}, keywords_fa = {داوری تجاری بین‌المللی,قانون حاکم,حقوق مذهبی,مراجع داوری,مقررات داوری}, url = {https://cjd.razavi.ac.ir/article_1276.html}, eprint = {https://cjd.razavi.ac.ir/article_1276_cab745e35fe6fa424254bf8c1391dd02.pdf} }
